The bank that issued DASK policy for the wrong property was found to be at fault
E.E., who lives in the Kocasinan district of the center, took out a valid DASK policy from an insurance company for the flat he resides in and owns.
However, E.E., who noticed that the complained bank had issued a DASK policy for another apartment in the same apartment without his knowledge and deducted 1703 liras and 5 kuruş from his account, called the bank's customer services and reported the situation.
E.E., who received the answer from the bank that he should ask for the money from the relevant department, applied to the Kocasinan District Consumer Arbitration Committee to resolve his grievance.
In its defense to the committee examining the application, the bank stated that the renewal was made in line with the UAVT code (DASK address code) in their system, that they acted only as an intermediary institution, agency, and that the collected premium was transferred to the insurance company, and requested the rejection of the unfair application.
The committee, which examined within the scope of the relevant articles of the Consumer Protection Law No. 6502, determined that the independent section where the consumer resides and owns is a different apartment, and that the complained bank did not fulfill its duty of care within the scope of its agency activity and issued a policy for the independent section that is not owned by the consumer.
The delegation found the consumer right by considering this transaction, which resulted from the bank's own system and operational error, as "defective service" and decided that the 1703 lira 5 kurus premium collected from E.E. due to the DASK policy issued to the wrong address should be refunded to the consumer by the bank.
Consumers Union Chairman Mahmut Şahin said that mistakes made during the issuance of DASK policies can victimize consumers and that policy and payment documents must be kept.
Şahin stated that obtaining receipts for cash payments and keeping transaction records for payments made via bank will make it easier for consumers to assert their rights in case of possible disputes.
